Terms of Service
Short version: Buy music to support Vanuatu artists, keep your access code private, and use downloaded albums for personal listening. Do not copy, upload, resell or share protected music.
1. Acceptance
These Terms govern use of Vanuatu Music app, website, album store, downloads and related services operated by South Pacific Domains, LLC ("Vanuatu Music", "we", "us" or "our"). By accessing or using service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use service.
2. Eligibility
You must be legally able to enter this agreement. A parent or guardian must approve use by anyone who cannot enter a binding agreement on their own.
3. Album purchases and access codes
- Prices are displayed before checkout. Payments are processed by Stripe or another identified payment provider under its own terms.
- A successful purchase provides a limited right to access applicable album through Vanuatu Music. It does not transfer copyright or ownership of master recordings, compositions, artwork or other intellectual property.
- Album access codes and device access are personal. Keep codes private and do not sell, publish or share them.
- We may verify purchase, device and entitlement records before allowing download, restoration or redownload.
4. Personal-use licence
Subject to these Terms and valid album access, you receive a limited, non-exclusive, non-transferable and revocable licence to download and play music for personal, non-commercial listening. You may not copy protected files outside supported app functions, distribute them, upload them, broadcast them, resell them, remove protection, reverse engineer access controls or use them to facilitate piracy.
5. Downloads, devices and redownload
Downloaded audio is stored locally and can be removed by uninstalling app, clearing app storage, resetting device or Android storage management. Eligible purchases may be restored or redownloaded after ownership verification, but permanent availability is not guaranteed where rights expire, artist content is withdrawn, service closes or legal restrictions apply. Keep device software current and maintain reasonable backups of information not supplied by service.
6. Artist rights
Music, names, artwork and related materials belong to their respective artists, labels, licensors or other rights holders. Vanuatu Music is designed to help local artists earn income from authorised digital album access. Nothing in these Terms permits piracy or unauthorised commercial use.
7. Acceptable use
You must not misuse service, interfere with security, access another person's entitlement, automate abusive requests, introduce malicious code, scrape protected content, evade technical limits or use service unlawfully. We may suspend access needed to investigate fraud, piracy, security threats, chargebacks or material breach.
8. Refunds and purchase problems
If payment succeeds but album code or download does not work, contact us with purchase details and album name. Do not send access code in public messages. Refund eligibility depends on circumstances, payment-provider rules and rights required by applicable law. Nothing in these Terms excludes consumer rights that cannot legally be excluded.
9. Service availability and updates
We may update app, change features, perform maintenance or discontinue parts of service. Internet access is required for purchase verification, initial download and some restoration functions. Offline playback depends on supported device, intact local files and valid access.
10. Disclaimers and liability
Service is provided on an "as available" basis to extent permitted by law. We do not promise uninterrupted or error-free operation. To extent permitted by law, we are not responsible for indirect or consequential loss, lost local files, incompatible devices or failures caused by third-party networks, platforms or payment services. These limits do not apply where liability cannot legally be limited.
11. Account and data deletion
You may request deletion through our account and data deletion page. Deleting entitlement records may prevent future restoration or redownload. Data handling is explained in our Privacy Policy.
12. Changes to these Terms
We may update these Terms when service, rights arrangements or legal requirements change. Updated Terms will appear on this page with new effective date. Continued use after update means you accept revised Terms where permitted by law.
13. Governing rules and disputes
These Terms are governed by applicable law. Before starting formal proceedings, contact us so we can try to resolve issue. Nothing here removes rights or remedies available under mandatory consumer law or limits jurisdiction of a court or authority where such limits are not permitted.
